During the battery-related patent litigation between LG Chem and SK Innovation, SK Innovation filed an invalidation lawsuit (IPR) with the US Patent Trial and Appeal Board (PTAB) eight times, but all were dismissed. This article intends to conduct a comparative overview, in Korea and the United States, on the effectiveness of patent invalidation trials and the benefits of parallel lawsuits where patent infringement lawsuits and invalidation trials are pursued at the same time.
